For Immediate ReleaseCorruption And Bribery In The DeKalb County Georgia Probate CourtDecatur, Georgia - September 13, 2008 -
Rampant corruption within the DeKalb County Georgia judicial system extends throughout the courts, even in the lower courts such as probate.
Case in point, Jeryl Debra Rosh, judge of the county's Probate Court has violated a litigant's right to due process and illegally removed a DeKalb County man as Co-Administrator of an estate in return for contributions for a re-election campaign in which she is running unopposed.
While accepting contributions from a Decatur attorney representing clients in a case before her court, DeKalb Probate judge, Jeryl Debra Rosh has committed illegal activities and breaches of her fiduciary duty, including but not limited to the following:
* Rosh allowed abusive litigation to be carried out in her courtroom and perpetrated fraud upon the court, when upon realizing that no claim existed in the original petition on which relief could be granted, she fabricated charges which were never claimed and used those fabricated charges as a basis for removal of a Co-Administrator of an estate;
* Rosh ignored admitted conflicts of interest on the part of the attorney's client, and appointed the client as sole Administrator of an estate despite the admitted intention of the client to use that authority to enforce an alleged land sale barred by State law and to defraud a beneficiary of his share of the estate;
* Rosh violated a defendant's right to due process by ruling on matters regarding conflicting claims to property and criminal allegations which lie outside the jurisdiction of her court while refusing to transfer the case to the appropriate court as required by law;
* Rosh ignored material evidence and allowed perjured testimony to be entered as fact, at one point during a hearing on April 3, 2008 Rosh rolled her eyes and stated from the bench "It doesn't matter if they lied" as a litigant attempted to prove perjury and fraud upon the court by the opposing party;
* Rosh has manipulated the record of the case by omitting documents filed in the probate court from the record;
* After accepting monetary contributions from the attorney, which totaled one half of her total contributions during that reporting period, Rosh failed to recuse herself from the case or to disclose receipt of the contribution to the other party in the case and continued to hear pleadings and issue rulings in the case;
* Rosh had the litigant and two witnesses illegally detained at the DeKalb County Court House following one of the hearings;
* Probate Court staff denied the litigant the right to file a Notice of Appeal following Rosh's issuing of the illegal court orders;
Crimes and conduct such as exhibited by Rosh in this case are intolerable in any court of law and such actions serve to erode public confidence in the judiciary.
Wherefore the above transgressions are considered, Citizens Against Judicial Corruption demands that Jeryl Rosh step down from her position as Probate Judge in DeKalb County Court. In the event of her refusal to voluntarily do so, CAJC recommends immediate impeachment.
